1. Acceptance of the PacMail Agreement

By accessing the PacMail Marketing platform and our arcade-inspired growth tools, you agree to be bound by these Terms of Service and our Privacy Policy. Our services are designed specifically for HVAC professionals seeking high-momentum growth. Any use of the dashboard or participation in our lead-generation campaigns constitutes full acceptance of these terms. If you do not agree to these conditions, you must cease use of the platform immediately.

2. Proprietary Arcade Branding & IP

The PacMail interface, including our signature 'Pac-Man Loco' aesthetic, proprietary lead-capture algorithms, and custom gaming-inspired motifs, are the exclusive intellectual property of PacMail. You are granted a limited, non-exclusive license to use these tools for your business growth. You may not reverse-engineer, scrape, or redistribute our campaign logic or visual assets without prior written consent from our legal department.

3. HVAC Professional Conduct

Users promise to utilize PacMail services for lawful business purposes only. This includes maintaining professional standards in all customer communications initiated through our platform. Prohibited conduct includes the use of automated bots for lead manipulation, harassment of competitors, or the posting of defamatory content. We reserve the right to suspend accounts that compromise the integrity of our high-score marketing ecosystem.

4. Performance & Liability Limits

While PacMail strives for 'Purposeful Momentum' in every campaign, we do not guarantee specific ROI or lead volumes due to the variable nature of local HVAC markets. In no event shall PacMail, its directors, or affiliates be liable for indirect, incidental, or consequential damages resulting from service interruptions. Our total liability is strictly limited to the amount paid for the service during the 30-day period preceding the claim.

5. Service Adjustments & Notice

We maintain the right to modify or discontinue features of the PacMail suite to enhance performance. For significant changes, including adjustments to subscription fees or core service deliverables, we will provide at least 30 days written notice via the primary email on your account. Continued use of the services after such modifications constitutes your agreement to the updated terms and pricing structures.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PacMail operates, without regard to conflict of law principles. Any legal action or proceeding related to your access to the service shall be instituted in the local courts. If any provision is found to be unenforceable by a court of competent jurisdiction, the remaining clauses of these Terms will remain in full force and effect.
