PACMAIL Terms & Conditions of Sale

These Terms & Conditions govern all orders, services, products, campaigns, subscriptions and related work provided by PACMAIL, a brand operated by Exit Proof LLC ("PACMAIL," "we," "our" or "us"). By placing an order, purchasing a subscription, approving a campaign, or using our services, you ("Customer," "you" or "your") agree to the following terms.

1. Services

PACMAIL provides marketing-related products and services, including but not limited to:

  • Direct mail postcard campaigns
  • Printing and mailing coordination
  • Bulk email marketing
  • Google Ads management
  • Facebook and Instagram advertising
  • Landing page and website services
  • Mailing lists and lead generation
  • Campaign reporting and marketing consultation

PACMAIL may use third-party vendors, printers, mailing houses, software providers, digital advertising platforms, contractors and service providers to fulfill all or part of your order.

2. Payment Terms

All orders and subscriptions must be paid in full before production, mailing, advertising, or campaign work begins, unless otherwise agreed in writing.

  • Subscription charges may be billed monthly, automatically, and in advance.
  • One-time campaign charges, postage, advertising spend, printing, mailing, list purchases and third-party costs are due when the order is placed.
  • Returned checks or failed payments may incur a $35 fee.
  • PACMAIL reserves the right to pause, delay or cancel services for unpaid balances.

Advertising platform charges, postage, mailing list fees and other third-party costs are non-refundable once incurred.

3. Approval of Artwork and Campaigns

Before printing, mailing or launching any campaign, you will receive proofs, mockups, drafts or campaign details for approval.

You are solely responsible for reviewing and approving:

  • Spelling, grammar and punctuation
  • Phone numbers, addresses, URLs and QR codes
  • Pricing, offers and business information
  • Images, logos and branding
  • Mailing lists and targeting criteria

Once you approve a proof or campaign, PACMAIL is not responsible for errors that were present in the approved version.

4. Customer Materials and Content

You represent and warrant that you have the legal right to use any logos, trademarks, text, images, photos, offers, mailing lists, customer data or other materials you provide.

You agree that PACMAIL will not be liable for claims arising from materials supplied by you, including but not limited to:

  • Copyright infringement
  • Trademark infringement
  • false advertising
  • Privacy violations
  • Violation of email, telemarketing or mailing laws

You agree to indemnify and hold PACMAIL harmless from any such claims.

5. Printing, Mailing and Delivery

PACMAIL coordinates printing and mailing through third-party production and postal providers.

  • Delivery dates are estimates only.
  • PACMAIL is not responsible for delays caused by the USPS, FedEx, UPS, printers, advertising platforms, weather, labor shortages, internet outages, acts of God or other events outside our control.
  • Once mail has been delivered to the USPS or another carrier, PACMAIL cannot stop, recall, reroute or refund the mailing.
  • Postage, shipping and mailing costs are non-refundable after the mail has been submitted.

Shipping charges, postage and mailing fees are in addition to the price of the campaign unless otherwise stated.

6. Email Marketing and Advertising Platforms

PACMAIL may manage or assist with email campaigns and digital advertising using third-party platforms such as Google, Meta, Smartlead, Mailgun, SendGrid or other providers.

You understand and agree that:

  • PACMAIL cannot guarantee inbox placement, open rates, click rates, advertising approval, ad delivery or specific results.
  • Advertising platforms may suspend or reject ads or accounts at their discretion.
  • Email service providers may limit or block messages.
  • Any platform terms, rules or policies are agreements between you and that third party.

You are responsible for complying with all applicable laws, including CAN-SPAM, TCPA, data privacy laws and advertising regulations.

7. No Guarantee of Results

Marketing results vary by industry, offer, list quality, competition, budget, seasonality and many other factors.

PACMAIL does not guarantee:

  • Any minimum number of leads, calls, sales or customers
  • Any specific return on investment
  • Any particular revenue increase
  • Any specific advertising or marketing result

Any examples, estimates, case studies, statistics or projections are illustrative only and do not guarantee future performance.

8. Refunds and Cancellations

Monthly subscriptions may be canceled with at least 30 days written notice.

The following items are non-refundable once work has begun or costs have been incurred:

  • Design work
  • Mailing list purchases
  • Printing
  • Postage
  • Shipping
  • Advertising spend
  • Email delivery costs
  • Third-party platform fees
  • Completed labor or consulting time

If PACMAIL cancels a project before any work begins, any prepaid amount not yet used may be refunded at PACMAIL's discretion.

9. Storage of Artwork and Mailing Materials

PACMAIL may store customer artwork, mailing lists, campaign files or print materials for convenience, but is not required to do so.

  • Campaign files and artwork may be deleted after 24 months.
  • Printed inventory or leftover materials may be discarded after 60 days unless otherwise arranged.
  • Storage fees may apply for longer periods.

10. Ownership of Work Product

Unless otherwise agreed in writing:

  • PACMAIL retains ownership of its internal templates, processes, software, systems, campaign structures and proprietary materials.
  • Upon full payment, you receive a license to use the final campaign materials created specifically for your business.
  • PACMAIL may display completed work, campaign examples, logos or general results in its portfolio, website or marketing materials unless you request otherwise in writing.

11. Limitation of Liability

To the fullest extent permitted by law, PACMAIL's total liability for any claim shall not exceed the amount actually paid by you for the specific service giving rise to the claim.

PACMAIL shall not be liable for:

  • Lost profits
  • Lost business opportunities
  • Indirect, incidental or consequential damages
  • Delays or failures caused by third parties
  • Postal, printing, delivery or advertising platform errors
  • Customer-supplied errors or inaccurate information

If an error caused directly by PACMAIL materially affects a mailing or campaign, PACMAIL's sole obligation will be, at our option:

  • Reprinting the affected materials
  • Re-mailing the affected campaign
  • Crediting the amount paid for the affected portion of the service

12. Privacy and Confidentiality

PACMAIL will take reasonable steps to protect confidential customer information and will not sell your customer lists or proprietary business information.

However, PACMAIL may share information with vendors, printers, mail houses, software providers, payment processors and advertising platforms as necessary to provide the services.

13. Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of the State of Wyoming, without regard to conflict-of-law principles.

Any dispute shall be resolved exclusively in the state or federal courts located in Wyoming.

14. Changes to These Terms

PACMAIL may revise these Terms & Conditions at any time. Updated versions will apply to all future orders and services after being posted on the PACMAIL website.

By placing an order or using PACMAIL services, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
